By purchasing any wine from La Maison Gourmet, you agree that you are bound by the following Terms and Conditions of sale:
All wine is sold ''AS IS,’’ without any representations or warranties, express or implied, including but not limited to, as to merchantability, fitness for a particular purpose or other description of physical condition.Anything ''old'' vintages are NOT guaranteed for drinkability.
These Terms and Conditions of sale, as well as your and our respective rights and obligations hereunder, shall the governed by and construed and enforced in accordance with the laws of the State of California. You consent to the exclusive jurisdiction with any wine purchased from La Maison Gourmet. In no event shall our liability ever exceed the purchase price actually paid by you for such wine.
LEGAL AGE
Wines may be sold and delivered only to a person who is at least 21 years old. In placing your order, you represent to us that you are at least 21 years old and the person to whom the wine will be delivered to is also 21 years old. At the time of delivery, all shipments containing alcohol require the signature of an adult who must show identification proving the legal drinking age at any time when requested.
Shipping to a business address is highly recommended, since an adult signature is required at time of delivery.
SALES TAX
All wine is sold in California, and title passes to the buyer in California. We make no representation relative to your right to import wines into your state or country. The customer, by placing an order, warrants to us that he/she is aware of and in compliance with the laws governing said shipment his/her area.California state sales tax of 8.75% will be applied to all orders to be shipped in California.
PROCESSING TIME, SHIPPING AND WEATHER
It is our goal to process and ship all orders as quickly as possible. Most orders will be processed within 24-48 hours of being placed. Most stock items will arrive in approximately 7 business days. Items are shipped by UPS. However, if you need it immediately, we offer you the options of Next Day and/or 2nd Day AIR for the shipping. If your order includes an item that is temporarily out-of-stock, but due to arrive within a few days, it will be delayed in effort to ship a complete order.In that event we will attempt to notify you by e-mail of the delay. You will be also notified of any delay over 21 days.
Some items may require additional shipping that will be billed to your credit card. You must provide us with your street address. We DO NOT ship to P.O. Box APO addresses. SHIPPING IS NEVER FREE.
It is imperative that all information included on the order is complete and accurate. Incomplete or inaccurate billing and/or shipping information on orders will result in a delay in processing and additional shipping charges.
La Maison Gourmet assumes no liability whatsoever for any loss, damage or deterioration caused by conditions beyond its control, including but not limited to acts of God, government restrictions, wars, insurrections, natural disasters, negligent or intentional acts of third parties.
Extreme weather conditions can affect your wine.Please keep in mind that La Maison Gourmet is not responsible for, and will not replace, wine that is damaged by extreme weather conditions.By placing your order online, you are accepting the responsibility for that shipment through whatever weather conditions may occur during the shipment.If you are not sure about your shipment, please do not hesitate to contact us by e-mail or at (949) 916-4810.
You also have the option to pick your wine up at La Maison Gourmet.Just select the option ''Pick Up'' when you checkout your transaction. The amount of your purchase is due on reception in store. We will keep the wine you have purchased for 7 business days at no additional charge.La Maison Gourmet may cancel the order at its discretion at any time.
Please note that some states have laws on the shipment of alcohol that prohibit us from shipping to addresses in those states. We cannot ship alcoholic beverages to: Alabama, Arkansas, Delaware, Iowa, New Hampshire, Mississippi, Montana, New Jersey, Oklahoma, Pennsylvania, Puerto Rico, South Dakota, Texas, Utah, Virgin Islands.
PRICES, DISCOUNTS AND AVAILABILITY
Although it rarely happens and that our website is accurate for its pricing, all prices are subject to change without notice. We reserve the right to correct any errors in pricing.
There are certain situations that may occur that an out-of-stock or a vintage may be changed with any of the wines that you order. Should that happen we would notify you by e-mail before your order will be processed.
Please call for discount on volume purchase. The allocated wines and the very small wine releases are not part of this discount program and cannot be combined with your order to benefit the discount.
All orders are subject to our acceptance and we may refuse any order at our own discretion.
RETURNS AND CANCELLATIONS
By law, we are unable to accept returns on wine unless the product is corked or flawed. We are also unable to accept returns on wine that has been damaged due to bad conditions during shipment. There will be a 10% restocking fee on all canceled orders. Pre-orders and special releases/orders cannot be canceled once order has been confirmed.
BOTTLE LIMITS
There is a limit of 2 bottle (750ml) per order and/or per person for any allocated wines and small releases of wines.

We accept Visa, Mastercard, American Express, Discover, Money order and cash. Please note that all credit cards are verified.
