Age Requirement
You must be at least 21 years of age to purchase wine or spirits. By placing an order through our website, you are representing yourself to us as at least 21 years of age. We reserve the right to ask for proof of identity before processing an order. An adult signature with proof of age verification is required at time of delivery. Please be aware that someone over the age of 21 must be available to sign for the package. If no one is available at the time of delivery, the package will not be left. We cannot ship wine to PO Boxes or APO addresses.
Shipping to a Business address is highly recommended, since an adult signature is required at time of delivery.
Carrier and Delivery Times
We ship Ground, Next Day Air, and 2nd Day Air via UPS:
- Ground Service - approximately 7 business days in transit
- 2nd Day Air - One business day in transit
- Next Day Air - One business day in transit
All orders will be confirmed via e-mail and processed within 2 business days. We will contact you by the end of the next business day if there are any problems with your order. You will be promptly notified by email of any unexpected delays in processing and/or shipping. Please note that the shipping is never free.
You also have the option to pick your wine up at La Maison Gourmet for an order of 6 bottles and more or $200 per order. Just select the option 'PICK-UP' when you checkout your transaction. We will keep the wine you have purchased for 7 business days at no additional charge. After this delay, we will add a $6 storage fee per each 12 bottle case (or portion of) per month for a maximum of 6 months and keep your order until you call us to set up shipping arrangements. La Maison Gourmet may cancel the order at its discretion at any time.
Billing Information
Orders placed on this website are not final. Your credit card is not charged automatically. A charge is put on your credit card after the product has been packed and the order is deemed complete. Please note that all credit cards are verified. You must provide a billing address that corresponds to the credit card you are using. If the billing address does not match the credit card you will be informed and the order will not be processed until we hear from you.
Sales Tax
All wine is sold in California, and the California state sales tax of 7.75% will be applied to all orders.
Payments
We accept Visa, Mastercard, Dicover, American Express, check and cash.
Prices, and Availability
All wine is sold 'AS IS,' without any representations or warranties, express or implied, including but not limited to, as to merchantability, fitness for a particular purpose or other description of physical condition. Anything 'old' vintages are NOT guaranteed for drinkability.
Although it rarely happens and that our website is accurate for its pricing, all prices are subject to change without notice. We reserve the right to correct any errors in pricing.
There are certain situations that may occur that an out-of-stock or a vintage may be changed with any of the wines that you order. Should that happen we would notify you by e-mail before your order will be processed.
For any allocated wines and small releases of wines, there is a limit of 2 bottles of 750mL per order and/or per person unless agreed in writing between the parties.
Shipping and Weather
If your order includes an item that is temporarily out-of-stock, but due to arrive within a few days, it will be delayed in effort to ship a complete order. In that event we will attempt to notify you by e-mail of the delay. You will be also notified of any delay over 30 days.
It is imperative that all information included on the order is complete and accurate. Incomplete or inaccurate billing and/or shipping information on orders will result in a delay in processing and addi-tional shipping charges.
La Maison Gourmet assumes no liability whatsoever for any loss, damage or deterioration caused by conditions beyond its control, including but not limited to acts of God, government restrictions, wars, insurrections, natural disasters, negligent or intentional acts of third parties.
Extreme weather conditions can affect your wine. During times of bad weather, we recommend using 2nd Day or Next Day shipping to avoid spoilage. Please keep in mind that La Maison Gourmet is not responsible for, and will not replace, wine that is damaged by extreme weather conditions. By placing your order online, you are accepting the responsibility for that shipment through whatever weather conditions may occur during the shipment. Shipping and Handling Costs
The shipping costs are automatically calculated at the time the order is placed. If you would like to know the shipping cost to a particular area please e-mail us your zip code and number of bottles. Prices of our wines do not include shipping/handling charges, which vary depending on destination, number of bottles ordered and choice of delivery options. We do not ship to foreign country.
Return and Cancellations
By law, we are unable to accept returns on wine unless the product is corked or flawed. We are also unable to accept returns on wine that has been damaged due to bad conditions during shipment.
There will be a 5% restocking fee on all cancelled orders. Pre-orders and special releases/orders cannot be cancelled once order has been confirmed.
Legal Disclaimer
The buyer assumes title of the wines once purchased. By arranging for transportation of the wine, we are providing a service to and acting on behalf of the purchaser. We make no representation to the legal rights of anyone to ship or import any wines into any state. The buyer is solely responsible for the shipment of wine and other goods purchased and for determining the legality and the tax/duty consequences of having the wine shipped to him or her. . In the event of dispute or litigation, the jurisdiction for any such dispute or litigation shall be the Superior Court, State of California, County of Orange.
